Estate Administration Representation

Estate administration is the process by which an estate is managed or distributed at the time of death. At Laidlaw Firm, LLC, we provide clients with tailored representation in many different aspects of estate administration.

In New York, an executor/executrix is named in the will. That person is then appointed a personal representative. If there is no will, the court will appoint someone to be the estate administrator. In either case, there are various procedures to go through.

A typical estate plan contains a will, a financial power of attorney, and perhaps a trust or trusts. Living wills or healthcare directives may also have been included in the plan.

Unless the estate plan succeeded in moving all of the decedent's assets into non-probate categories, probate is mandatory.

Your duties as a personal representative include:

  • Perform an accounting of the estate to determine its assets and debts
  • Pay any remaining debts
  • Pay estate taxes
  • Distribute any remaining assets to heirs or beneficiaries according to the will and New York law
